I'm sorry that some exercise their ability to post comments in a way that helps no one and seeks to divide further along some immutable personal characteristic line. Although I do not have time to read all comments, I read some. And if I read one that may create a perception of me by association, I will delete it. So, I just deleted a comment. I feel badly about that because I believe in free speech. It would be fine if this were some open platform like a public square where people post how they feel. They only make themselves look bad. But Substack is not really like that. This is my article and if someone posts something egregiously hate-filled, and I happen to read it, then I feel morally obligated to delete it, like I just did. There may be more that I have not read. I don't have time to monitor all the comments. So there may be more. But I saw this one. So I had to delete it. Bummer.
"All these deaths could have been avoided if access to the courts was not blocked by Dismissal Doctrines. Beaudoin v. Baker, supra, was dismissed on Standing through citing Iqbal among others. Exhibit F, supra, contains hard evidence of felonies committed every day by agents of the Commonwealth of Massachusetts; and it was not heard by the court."
Dismissed for lack of standing seems to be a tactic to protect government abuses. Most famously in my memory was 2012 Hedges vs Obama over NDAA domestic spying in the war on terror.. it wasn't until hacktivists liberated the Stratfor files that proved the government was spying on journalists that standing was then granted and other NatSec excuses used to dismiss the case. It's shameful how rigged the system has become in favor of corp-gov powers & go you for staying in the fight!!
This is one of the most important and enlightening emails I have read all year. We watched as the 2020 election cases were dismissed over utter BULLSHIT claims about standing, Obama's eligibility to even run for President was not heard, and on and on. What are we PAYING the judiciary for? They DO produce justice sometimes, but this article fingers the judiciary as a huge key to the divisions of our society, and much horror. If we want the Rule of Law, we need to fund not only the police, but the courts. And we need to IMPEACH bad justices.
I want to tell every Patriot and all my contacts about this post.
John, thank you for your work on this critical matter. I have followed your studies and appreciate your scientific and judicial actions. I wish you success!
I come here after reading in the Guardian today of an innocent man who about to be executed on Friday in SC. Khalil Allah like many innocent people is considered unrepentant as he has not admitted to the crime. However, as he did not do it, he is more honorable, not less! This is such cruel irony.
And there's another in Missouri, Marcellus Williams, scheduled to be murdered next Tuesday 9/24, if I recall correctly, after evidence that supported his innocence had been destroyed and the court of appeals wussed out. The innocence project has details and a phone # to call the governor, which is evidently our last resort to prevent his murder.
I called the governor's office, laid out the case as I understand it, and encouraged him to have some balls and do the right thing, and vacate the conviction. Or at least order a stay and retrial.
This needs to be republished in a month or two--with a MUCH BETTER title giving a hint as to how important it really is, and a hint that the reader has NOT heard this one before. And it needs to go to all sides of the political spectrum and to Downsize DC.
Just a portion he first paragraph of the petition is all that needed to be said:
“Congress shall make no law ... abridging ... the right of the people ... to petition the Government for a redress of grievances,”
The fact this petition took however many thousands of words, replete with obsecure legalistic bullshit, clearly highlighted what is wrong with the legal system.
I do not believe it was the intent of our nation's founders to imply any absence of a right for said petition to get a fair hearing, either, to counter any further BS sophistry to the contrary.
But the writing's on the wall. It's all so very unsustainable. Things happen fast these days, and can only go so far out of balance before reality takes the stand in the much higher court that presides over all, whatever their (ahem!) standing.
The legal system is just like the medical system .... They make up rules as they go and use double speak lingo, like legalese and medical terminology.
Standing is bullshit that crooked judges started using in order to not hear cases that can prevent bad laws and orders from being implemented.
It's made up bullshit like most of the legal system....
What's the point of checks and balances when all branches serve the same ma$ter$?
Exacatically. Standing: (synonym, Bullshit)
